Terms of Service

1. Agreement

These Terms of Service (Terms) govern your use of the Moyola HR platform (Service) provided by Moyola AI (Company, we, us), a company registered in Northern Ireland.

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

Moyola HR is an AI-powered human resources management platform that provides:

  • A conversational AI agent for HR queries and operations.
  • Employee record management.
  • Leave tracking and approval workflows.
  • Document management with AI-powered search.
  • Onboarding and offboarding workflows.
  • FETO compliance monitoring and ECNI annual returns (Northern Ireland).
  • Recruitment and applicant tracking.
  • HR reporting and analytics.

3. Account registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You must notify us immediately at support@moyolahr.com if you suspect unauthorised access to your account.

4. Subscription and payment

The Service is offered on a monthly or annual subscription basis across the following tiers:

  • Starter (up to 20 employees): £59/month
  • Growth (up to 50 employees): £149/month
  • Business (up to 200 employees): £359/month
  • Enterprise: Custom pricing

Payments are processed securely via Stripe. All prices are in GBP and exclude VAT where applicable. We reserve the right to change pricing with 30 days notice.

5. Your data

You retain ownership of all data you upload to the Service. We process your data solely to provide the Service, as described in our Privacy Policy.

You are responsible for ensuring you have the lawful basis to process the personal data of your employees through our platform, including any special category data required for FETO monitoring.

6. AI-generated content and employment law guidance

The AI assistant provides responses based on documents and data you upload, as well as general employment law guidance derived from publicly available UK and Northern Ireland government and regulatory sources.

This information is general guidance only and does not constitute legal advice. Moyola AI Ltd accepts no liability whatsoever for any actions taken or decisions made based on AI-generated responses, including but not limited to employment law guidance, HR recommendations, compliance suggestions, or any other information provided by the platform.

No solicitor-client or advisory relationship is created between you and Moyola AI Ltd through your use of the Service or any AI-generated content.

You are solely responsible for seeking independent, qualified legal advice before acting on any information provided by the AI assistant.

The AI assistant may produce inaccurate, incomplete, or outdated responses. You should independently verify all AI-generated content with qualified legal or HR professionals before making any decisions or taking any actions based on it.

7. FETO compliance

The FETO monitoring features are designed to assist registered employers with their obligations under the Fair Employment and Treatment (Northern Ireland) Order 1998. However:

  • You remain solely responsible for compliance with FETO obligations.
  • The Service assists with monitoring and reporting but does not guarantee compliance.
  • You should verify all ECNI returns before submission.

8. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorised access to other users data or accounts.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to store or transmit malicious code.
  • Exceed reasonable usage limits or use the Service in a way that degrades performance for other users.

9. Service availability

We aim to provide 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control.

10. Limitation of liability

To the maximum extent permitted by law, Moyola AI Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly.

Without limiting the foregoing, Moyola AI Ltd accepts no liability whatsoever for any loss, damage, or adverse outcome arising from reliance on AI-generated content, employment law guidance, HR recommendations, or any other information provided through the Service. This exclusion applies regardless of whether such information was accurate, complete, or current at the time it was provided.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period.

We may suspend or terminate your access if you breach these Terms, with notice where practicable. Upon termination, we will delete your data in accordance with our Privacy Policy.

12. Governing law

These Terms are governed by the laws of Northern Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
